The Trump administration has asked the DC Circuit Court for a stay of the James Boasberg District Judge that temporarily prevented the Government to deport Venezuelans using the Alien Enemies Law.

The White House argues that Boasberg lacked jurisdiction to enter the temporary restriction order, which the administration describes in a presentation before the Court of Appeals as “unprecedented.”

The Government argues that Trump’s actions invoking the AEA “are not subject to a judicial review” and that “there was no legal basis” for the court to order the implementation of the president’s proclamation.

“If this tro is allowed to stand up,” writes the Department of Justice, “the district courts would have a license to order virtually any urgent national security action upon receiving a complaint.”

The DC circuit ordered an response to the emergency motion to stay on Tuesday at 5 PM by lawyers representing the plaintiffs in the underlying case.
